Rostenkowski case proceeds slowly

THE federal judge in Rep. Dan Rostenkowski's fraud case said she would rule soon on his motion to dismiss the charges but expects her ruling to be appealed.

The Illinois Democrat was indicted on 17 felony counts May 31. He is charged with converting $636,600 in federal funds and $56,267 in campaign funds to his personal use.

Prosecutors say Mr. Rostenkowski violated House rules by hiring employees who did little or no official work, used the House post office to embezzle money, and obstructed justice. Defense lawyers say the prosecutors cannot bring in the issue of House rules because under separation of powers such rules can be enforced only by the legislative branch and not the executive.
